1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of our website, online store, content, communications, and related services (collectively, the "Service"), and your purchase or use of wigs, hair extensions, hairpieces, closures, frontals, tools, accessories, and other products we offer (collectively, "Products").

By accessing the Service, creating an account, placing an order, or clicking to accept these Terms, you agree to these Terms and to all policies incorporated by reference, including our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree, do not use the Service or place an order.

If you use the Service for a business or another person, you represent that you have authority to bind that business or person. You must be at least the age of majority where you live to place an order. A parent or legal guardian is responsible for a minor's permitted use of the Service.

Our store may be hosted by Shopify Inc. Shopify provides the e-commerce platform but is not the seller of our Products.

2. Product Information and Hair-Specific Expectations

We make reasonable efforts to describe and display Products accurately. However:

• screens, lighting, photography, and device settings may affect how colors appear;

• texture, curl pattern, density, length, knots, lace color, and construction may vary slightly between units and production batches;

• measurements are approximate and may vary based on how a Product is measured;

• human-hair Products may contain natural variations in shade or strand characteristics; and

• styling, washing, coloring, bleaching, heat, adhesives, cutting, plucking, chemical processing, improper storage, and normal wear can change a Product and shorten its useful life.

These reasonable variations are not defects. Product descriptions are not guarantees of a particular styling result, lifespan, color match, or fitness for an unstated purpose. Unless we expressly state otherwise in writing, Products are sold for personal cosmetic use only and are not medical devices or treatments.

You are responsible for reviewing the full listing, selecting the correct Product, and consulting a qualified stylist or health professional when appropriate. Always perform strand, patch, adhesive, and heat tests before full application. Stop use and seek appropriate medical advice if irritation or another adverse reaction occurs. We do not provide medical advice.

3. Orders, Acceptance, and Availability

Your order is an offer to purchase. An automated order confirmation only confirms receipt; it does not mean we have accepted the order. We accept an order when we send a shipping confirmation or otherwise expressly confirm fulfillment. We may refuse, limit, hold, or cancel an order before acceptance for reasons including suspected fraud, payment or address issues, inventory errors, pricing errors, resale activity, abusive conduct, or legal or operational restrictions.

Products may have limited quantities. We may set purchase limits, discontinue Products, or restrict sales by customer, household, account, payment method, address, or region. If we cancel a paid order, we will refund the canceled amount to the original payment method, subject to applicable law and payment-processor timing.

4. Prices, Taxes, Discounts, and Payment

Prices and availability may change without notice. Applicable taxes, shipping charges, duties, and other disclosed charges are added at checkout. You authorize us and our payment processors to charge the payment method you provide for the total shown at checkout.

Discounts, promotional codes, store credits, and gift cards are subject to their stated terms, may not be combined unless expressly allowed, have no cash value except where required by law, and may be corrected or canceled if obtained or used through error, fraud, or abuse. If a price or promotion is clearly erroneous, we may cancel the affected order and issue any legally required refund.

You represent that all billing, shipping, contact, and payment information is accurate and that you are authorized to use the payment method submitted. We may request identity, payment, or address verification. Failure to complete requested verification may delay or cancel an order.

5. Shipping, Delivery, and Risk of Loss

Processing and delivery estimates are estimates, not guarantees, unless we expressly state otherwise. We will comply with applicable federal shipping-delay and refund requirements. You are responsible for providing a complete, secure, and accurate delivery address before fulfillment. Contact us immediately if you notice an error; we cannot guarantee that an address can be changed after an order enters processing.

Title and risk of loss pass as provided by applicable law and the carrier's delivery records. Nothing in this paragraph removes any non-waivable consumer right. We are not responsible for delays caused by carriers, weather, labor disruptions, customs, incorrect addresses, access restrictions, or other events outside our reasonable control, but we will provide any remedy required by law.

If tracking shows delivered but you cannot locate the package, promptly check the delivery area, household members, neighbors, building management, and the carrier, then contact us. For a visibly damaged, incomplete, incorrect, or apparently tampered-with shipment, contact us at info@latourhairbeautyplus.com within 48 hours after delivery and keep all Products, packaging, labels, and shipping materials. Photos or other reasonable documentation may be required so we can investigate. This notice period helps us investigate and does not eliminate rights that cannot legally be waived.

International customers are responsible for customs duties, import taxes, brokerage fees, and compliance with local import rules unless checkout expressly states otherwise. Refused or unclaimed international shipments may be refunded, if appropriate, less lawful nonrefundable shipping, return, duty, or carrier charges.

6. Returns, Exchanges, and Hygiene Controls

Our Return & Refund Policy is incorporated into these Terms. Because wigs, hair extensions, hairpieces, and related Products are personal-wear and hygiene-sensitive goods, a return or exchange is eligible only if it satisfies that policy and applicable law.

Unless the Return & Refund Policy or applicable law states otherwise, hair Products must be unworn, uninstalled, unaltered, unused, unwashed, uncut, uncolored, and free of odors, products, adhesive, makeup, or damage. All original lace, bands, ties, tags, packaging, gifts, and accessories must remain intact. A Product is not eligible for return after lace or bands are cut; knots are bleached; hair is washed, colored, chemically treated, heated, styled, plucked, installed, or exposed to adhesive; bundles are unwrapped or separated; or tags or hygiene seals are removed.

Authorization to send an item back does not guarantee a refund. We inspect returned Products and may deny a return that does not meet the policy. Unauthorized returns may be refused or sent back at the customer's expense where permitted by law. Original and return shipping charges are nonrefundable unless the return is due to our verified error, a verified defect, or applicable law requires otherwise. Refunds are issued to the original payment method; processing times vary by financial institution.

If a Product arrives incorrect, incomplete, damaged, or defective, follow the notice and documentation process in Section 5. We may offer an appropriate replacement, repair, store credit, or refund, consistent with the Return & Refund Policy and applicable law. Nothing in these Terms limits rights or remedies that cannot legally be waived.

7. Custom, Preorder, Final-Sale, and Digital Items

Products identified before purchase as custom, personalized, made-to-order, preorder, clearance, closeout, final sale, gift card, or digital are not returnable or exchangeable except where required by law or when we confirm that the item was incorrect, damaged on arrival, or defective. Estimated availability dates for preorders and made-to-order Products may change. If a material delay occurs, we will provide the notice and options required by law.

8. Cancellations and Order Changes

Submit cancellation or change requests as soon as possible. We may honor a request only before processing or fulfillment begins. Once an order is processed, customized, or shipped, it is governed by the Return & Refund Policy. Refusing delivery does not automatically cancel an order and may result in lawful carrier or return charges being deducted from any refund.

9. Chargebacks and Payment Disputes

Contact us first at info@latourhairbeautyplus.com so we can investigate a billing or fulfillment concern. You retain all rights provided by your card issuer and applicable law. You agree not to knowingly submit false information, claim that an authorized purchase was unauthorized, or pursue both a refund from us and a chargeback for the same amount. We may provide order records, acceptance logs, communications, fraud-screening results, shipment details, delivery confirmation, and policy disclosures to payment processors, financial institutions, carriers, insurers, or authorities as reasonably necessary to investigate or respond to a dispute, subject to our Privacy Policy and applicable law.

10. Product Care, Installation, and Assumption of Risk

Follow all care and safety instructions. Installation, adhesive use, chemical processing, bleaching, coloring, cutting, heat styling, and maintenance should be performed carefully and, where appropriate, by a qualified professional. You assume the ordinary risks of choosing, installing, altering, and using a Product after delivery, except to the extent caused by our violation of law or a non-waivable duty.

We are not responsible for damage caused by misuse, failure to follow instructions, improper installation or removal, excessive heat, chemicals, adhesives, unauthorized modification, neglect, normal wear, or services performed by a third party. A stylist, installer, carrier, marketplace, payment provider, or other third party is not our agent unless we expressly state otherwise in writing.

11. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly of suspected unauthorized access. We may suspend or close an account to protect customers, Latour, or the Service, investigate misuse, or enforce these Terms.

12. Acceptable Use

You may not use the Service to violate law; infringe intellectual-property, privacy, publicity, or other rights; submit false or misleading information; impersonate another person; distribute malware; scrape or harvest data without permission; interfere with security or operation; make fraudulent purchases or claims; harass others; or resell, reproduce, copy, or commercially exploit the Service or its content without our written permission. We may restrict or terminate access for suspected violations.

13. Intellectual Property

The Service and its text, graphics, product photography, logos, brand elements, designs, videos, software, and other content are owned by or licensed to Latour and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Service for personal, lawful shopping purposes. No other rights are granted.

14. Reviews, Photos, and Other Submissions

You retain ownership of content you submit. By submitting a review, photo, video, comment, idea, or other content to us or tagging us in content you expressly invite us to share, you grant Latour a worldwide, nonexclusive, royalty-free, sublicensable license to host, reproduce, format, publish, display, and distribute that content for operating and promoting our business, subject to applicable law. You represent that you own or have permission to submit the content and that it is accurate and does not violate another person's rights.

We may moderate or remove submissions, but we are not obligated to do so. We will not condition a benefit on a review expressing a particular sentiment, and nothing in these Terms prohibits an honest review or other legally protected consumer communication.

15. Third-Party Services and Links

The Service may rely on or link to third-party platforms, payment processors, carriers, social networks, or tools. We do not control and are not responsible for their independent content, policies, availability, or acts. Your use of a third-party service may be governed by that party's terms. Review those terms before use.

16. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. It is incorporated into these Terms. Payment-card information is processed by our payment providers; we do not promise that any electronic system is completely secure.

17. Mobile Messaging Terms

If you separately opt in to Latour's SMS/MMS program, you may receive recurring marketing and informational messages at the mobile number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. We or our service provider may use automated technology where permitted by law.

You confirm that you are the subscriber or customary user of the number provided and are authorized to consent. Reply STOP to unsubscribe and HELP for help. You may also revoke consent through any other reasonable method required by applicable law, including contacting us at info@latourhairbeautyplus.com. We will honor valid revocation requests within the period required by law, although you may receive a confirmation message. Carriers are not liable for delayed or undelivered messages.

If you change, transfer, or deactivate your number, promptly unsubscribe and notify us so messages are not sent to a new user. We may change the sending number or suspend or end the program. Mobile-message consent and records are handled under our Privacy Policy.

18. Service Changes, Errors, and Availability

We may correct errors, update information, change prices, limit quantities, modify features, or suspend or discontinue all or part of the Service. If an error affects an order, we may contact you, cancel the affected portion, and issue any refund required by law. We do not guarantee uninterrupted, secure, or error-free access.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Service and Products are provided "as is" and "as available," except for any express written warranty we provide. We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement, to the extent those warranties may lawfully be disclaimed. We do not disclaim warranties or consumer protections that cannot legally be excluded.

20. Limitation of Liability

To the fullest extent permitted by law, Latour and its owners, officers, employees, affiliates, contractors, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to the Service or Products, even if advised that such damages were possible.

To the fullest extent permitted by law, Latour's total liability for a claim will not exceed the greater of (a) the amount you paid Latour for the Product or transaction giving rise to the claim or (b) $100. These limitations do not apply to fraud, willful misconduct, gross negligence where liability cannot be limited, personal injury caused by a legally actionable Product defect, or any other liability that applicable law does not allow us to exclude or limit.

21. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Latour and its owners, officers, employees, affiliates, contractors, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs (including attorneys' fees) arising from your unlawful misuse of the Service, your content, your material breach of these Terms, or your violation of another person's rights. This section does not require you to indemnify a protected party for that party's own unlawful conduct, negligence, or willful misconduct.

22. Dispute Resolution; Missouri Law and Venue

Before filing a lawsuit, you and Latour agree to make a good-faith effort to resolve the dispute informally. Send a written notice describing the dispute, supporting facts, requested relief, and your contact information to info@latourhairbeautyplus.com. The receiving party will have 30 days to respond. This process does not prevent either party from seeking urgent injunctive relief, filing in small-claims court, meeting a legal deadline, or exercising a right that cannot be waived.

These Terms and any dispute arising from them are governed by the laws of the State of Missouri, without regard to conflict-of-law rules, except where federal law applies. Subject to any non-waivable consumer right, the parties consent to exclusive jurisdiction and venue in the state courts located in St. Louis County, Missouri, or the federal court with jurisdiction over that county.

23. Changes to These Terms

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively when posted or on any later date stated. If required by law, we will provide additional notice or obtain consent. Your continued use of the Service after the effective date means you accept the updated Terms; changes do not retroactively alter a dispute that arose before the updated Terms took effect.

24. Termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or if we discontinue the Service. Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limits, indemnification, and dispute terms—will survive.

25. General Terms

If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, sale, reorganization, or transfer of the business or Service. We are not liable for delay or failure caused by events beyond our reasonable control, subject to remedies required by law.

These Terms and the policies incorporated by reference are the entire agreement between you and Latour concerning the Service and replace prior agreements on the same subject. If these Terms conflict with a Product-specific written term or a policy, the more specific term controls for that subject, except that applicable law always controls.
